I. Introduction


Welcome to Dimensional Wellness, where your privacy is our priority. This Notice of Privacy Practices (“Notice”) explains how your protected health information (“PHI”) may be used and disclosed, and how you can access this information. Please review this notice carefully.


II. Our Commitment to Your Privacy


We are committed to maintaining the privacy of your personal and health information. We are required by law to provide you with this Notice of Privacy Practices that explains our legal duties and privacy practices concerning your PHI.


III. Uses and Disclosures of Your Protected Health Information


We typically use and share your PHI for the following purposes:


  • To treat you: We may use and disclose your PHI to provide, coordinate, or manage your mental health care and related services.  

  • To bill for your services: We may use and disclose your PHI for billing and payment purposes, including working with your insurance company or other third-party payer.

  • To run our organization: We will disclose your protected health information as necessary and as permitted by law, for our healthcare operations. These operations include clinical improvement, professional peer review, business management, accreditation and licensing, and other activities necessary to maintain optimal levels of service.


We may disclose your protected health information to our business associates, who provide us with services necessary to maintain business operations. We will only provide the minimum information necessary for these associates to perform their functions as it relates to our operations. For example, we may use a third-party merchant processor to assist in our credit card billing services, but this merchant will never have access to your medical record. Please understand that all of our business associates are obligated to comply with the same privacy and security laws that we adhere to. Additionally, all of our business associates are under contract with us and are committed to protecting the privacy and security of your protected health information.


While the purposes outlined above are the most common purposes for using and sharing your PHI, we are also permitted to share your PHI in other ways, as listed below.  However, we typically have to meet certain conditions in the law before we can share your information for these purposes.   • To comply with legal requirements: We will share information about you if state or federal laws require it, including with the Department of Health and Human Services if it wants to see that we’re complying with federal privacy law. 

  • To report suspected abuse, neglect, or domestic violence. Your protected health information may be disclosed to the appropriate governmental agency if there is belief that a patient has been or is currently the victim of abuse, neglect, or domestic violence and the patient agrees to the disclosure, or if the provider is required by law to report the suspected abuse. In addition, your information may also be disclosed to prevent a serious threat to your health or safety or to the health and safety of others.

  • To respond to lawsuits and legal actions.  We can share health information about you in response to a court or administrative order, or in response to a subpoena.

  • For workers’ compensation claims. We may disclose a limited amount of your protected health information when necessary to comply with a workers’ compensation request. This information may be reported to your employer and/or your employer’s representative regarding an occupational injury or illness.

  • Certain other purposes.  We are permitted and/or required by law to make certain other uses and disclosures of your protected health information without your consent or authorization under the following circumstances.

    • For public health activities or in connection with public health investigations;

    • To a governmental oversight agency conducting audits, investigations, or pursuant information in connection with civil or criminal proceedings;

    • To coroners or funeral directors, when the request is appropriate and made consistent with law;

    • If you are a member of the military, for national security or intelligence activities; and

    • For any other purpose required by law.


We will obtain your written authorization before using or disclosing your PHI for purposes other than those listed in this Notice.


IV. Your Rights Regarding Your Protected Health Information


You have the following rights regarding your PHI:


  • The right to get an electronic or paper copy of your medical record.  You can ask to see or get an electronic or paper copy of your medical record and other health information we have about you. Ask us how to do this. We will provide a copy or a summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.

  • The right to ask us to correct your medical record. You have the right to request an amendment to your PHI if you believe it is inaccurate or incomplete. We may say “no” to your request, but we’ll tell you why in writing within 60 days.

  • The right to request restrictions on your information we use or share. You can ask us not to use or share certain health information for treatment, payment, or to run our business. We are not required to agree to your request, and we may say “no” if it would affect your care.

  • The right to receive a list of those with whom we have shared your information. You can ask for a list (accounting) of the times we’ve shared your health information for six years prior to the date you ask, who we shared it with, and why. We will include all the disclosures except for those about treatment, payment, and health care operations, and certain other disclosures (such as any you asked us to make). We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.

  • The right to request confidential communications. You have the right to request confidential communication of your PHI. You can ask us to contact you in a specific way (i.e., by home or office phone) or to send mail to a different address. We will say “yes” to all reasonable requests.

  • The right to receive a paper copy of this Notice. You have the right to obtain a paper copy of this Notice upon request.

  • The right to choose someone to act for you.  If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information. We will make sure the person has this authority and can act for you before we take any action.

  • The right to file a complaint if you feel your rights are violated.  If you believe your privacy rights have been violated, you may complain to us by contacting us using the contact information in Section VI of this Notice.  You may also file a complaint with the Secretary of the Department of Health and Human Services Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/.  We will not retaliate against you for filing a complaint.


V.  Your Choices

For certain health information, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situation described below, talk to us. Tell us what you want us to do, and we will follow your instructions.


To contact individuals involved in your care. We may from time to time disclose your protected health information to designated family, friends and others who are involved in your care or in payment of your care. If you are unavailable, incapacitated, or facing an emergency medical situation and we determine that a limited disclosure may be in your best interest, we may share limited protected health information with such individuals without your approval. We may also disclose limited amounts of your protected health information to a public or private entity that is authorized to assist in disaster relief efforts in order for that entity to locate a family member or other persons that may be involved in some aspect of caring for you. 

If you are not able to tell us your preference, for example if you are unconscious, we may go ahead and share your information if we believe it is in your best interest. We may also share your information when needed to lessen a serious and imminent threat to health or safety.

In these cases we never share your information unless you give us written permission:

  • Marketing purposes

  • Sale of your information

  • Most sharing of psychotherapy notes

  • Disclosure of information about substance use disorders


Regarding the disclosure of psychotherapy notes, we must obtain your specific written authorization prior to disclosing any psychotherapy notes unless otherwise permitted by law. However, there are certain purposes for which we may disclose psychotherapy notes without obtaining your written authorization, which include the following scenarios.

  • To carry out certain treatment, payment or healthcare operations (e.g. to defend ourselves in a legal action or other proceeding brought by you);

  • To the Secretary of the Department of Health and Human Services as required by law;

  • For health oversight activities authorized by law; or

  • To medical examiners or coroners as permitted by law.


Regarding disclosures of information relating to substance use disorders, unless otherwise obligated by law, we must obtain your written authorization to disclose any information we maintain about your personal use with drugs or alcohol.


We will not use or disclose your information as part of fundraising efforts.

VII. Changes to this Notice


We reserve the right to change this Notice. The revised Notice will be effective for information we already have about you as well as any information we receive in the future. We will provide a copy of the revised Notice upon request.

DIMENSIONAL WELLNESS

TERMS OF USE

These terms and conditions of use (“Terms of Use” or “Terms”) govern your use of our online interfaces and properties (e.g., websites and mobile applications) owned and controlled by the Lotus Center, LLC d/b/a Dimensional Wellness (“Dimensional Wellness,” “we,” “us,” and “our”), including the https://www.atransformativejourney.com/ website (collectively, the “Site”), as well as the services available to users through the Site. Dimensional Wellness licensed behavioral health clinicians (collectively, our “Providers”) connect with patients via telehealth to provide psychotherapy services. The clinical services and the non-clinical Site services are collectively referred to in this Terms of Use as the “Services.” The terms “you” and “your” means you, your dependent(s) if any, and any other person accessing the Site and/or using the Services.  


Your acceptance of, and compliance with, these Terms of Use and the Privacy Policy (which is hereby incorporated and made a part of these Terms) is a condition to your use of the Site and Services. By clicking “accept”, you acknowledge that you have read, understand, and accept all terms and conditions contained within these Terms of Use and our Privacy Policy. If you do not agree to be bound by these terms, you are not authorized to access or use this Site or Services; promptly exit this Site. 


Dimensional Wellness reserves the right to modify these Terms of Use at any time, effective upon posting. Any use of this Site after such changes will be deemed an acceptance of those changes. You agree to review the Terms of Use each time you access this website so that you may be aware of any changes to these Terms.


NOT FOR USE IN CASE OF EMERGENCY; IF YOU ARE EXPERIENCING A MEDICAL OR MENTAL HEALTH EMERGENCY, YOU SHOULD DIAL “911” IMMEDIATELY. 

Dimensional Wellness’ Site and Services are not for medical or mental health emergencies or urgent situations. You should not disregard or delay to seek medical advice based on anything that appears or does not appear on the Site. If you believe you have an emergency, call 9-1-1 immediately. If you are experiencing suicidal or self-harm thoughts or tendencies, you should immediately call the National Suicide Hotline at 1-800-273-8255.


You should seek emergency help or follow up care when recommended by a Provider or when otherwise needed. You should continue to consult with your primary provider and other healthcare professionals as recommended. 

The content of the Site, including without limitation, text, copy, audio, video, photographs, illustrations, graphics, and other visuals, is for informational purposes only and does not constitute professional medical or psychological advice, diagnosis, treatment, or recommendations of any kind by Dimensional Wellness. You may always seek the advice of your qualified health care professionals with any questions or concerns you may have regarding your individual needs and any medical conditions. 


OVERVIEW OF SERVICES

Dimensional Wellness endeavors to help anxious people stuck in patterns of codependency to identify and reprogram their subconscious behavioral patterns and beliefs to attract healthy and empowering relationships.

Dimensional Wellness Providers are licensed behavioral health clinicians who provide psychotherapy services which incorporate holistic or alternative interventions. The clinical services are provided through telehealth. 


Dimensional Wellness is not an in-network provider with any insurance companies.  Accordingly, all of our clients must pay out of pocket for any clinical services provided. However, if you have out-of-network benefits through your insurance, you have the option to submit a claim to your insurer for reimbursement if you have a qualifying diagnosis. If you choose to file a claim with your insurer, you understand and acknowledge that your insurer may request additional information from Dimensional Wellness, and you authorize the release of any medical information necessary to process insurance claims for the clinical services provided to you or your dependents by Dimensional Wellness.


AVAILABILITY OF SERVICES

Dimensional Wellness and the Providers operate subject to state and federal regulations, and the Services may not be available in your state. You represent that you are not a person barred from enrolling for and/or receiving the Services under the laws of the United States or other applicable jurisdictions in which you may be located. Access to and use of the Site and/or the Services is limited exclusively to users located in States within the United States where the Services are available. Services are not available to users located outside the United States. Accessing the Services from jurisdictions where content is illegal, or where we do not offer Services, is prohibited.  Currently, the clinical services are available only to users located in Florida, Georgia, and New York.


ELIGIBILITY 

Only individuals 18 years of age and older who are located in states in which the Services are offered may use the Services. Dimensional Wellness does not discriminate against clients or prospective clients on the basis of gender, sex, race, color, national origin, sexual orientation, gender identity, age, disability, or any other basis. However, there may be unrelated circumstances that may warrant, in the sole discretion of the Provider, either: (1) the Provider declining to treat you; or (2) the termination of the Provider-client relationship. The Provider may decline to treat you or determine to terminate the Provider-client relationship for a number of reasons, including, but not limited to:

  • If you have or develop a condition or issue that the Provider feels he/she/they is not well-suited to treat;

  • If you cease making progress towards your goals;

  • If you cease making an effort to make progress towards your goals;

  • If the Provider determines your symptoms are too severe or are becoming more severe and that you require a higher level of care;

  • If you miss or cancel 3 appointments without adequate notice; and

  • If you commit or threaten to commit a violent act against the Provider or during a session with your Provider.


If a Provider declines to treat you, or if your Provider terminates your Provider-client relationship, the Provider will endeavor to provide you with resources or referrals to start or continue (as applicable) treatment elsewhere, if needed. 


SITE ACCESS AND SECURITY

You are prohibited from violating or attempting to violate the security of the Site, including, without limitation, (a) accessing data not intended for such user or logging onto a server or an account which the user is not authorized to access; (b) attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; or (c) accessing or using the Site or any portion thereof without authorization, in violation of these Terms of Use or in violation of applicable law. 

You may not use any scraper, crawler, spider, robot, or other automated means of any kind to access or copy data on the Site, deep-link to any feature or content on the Site, bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Site. Violations of system or network security may result in civil or criminal liability. Dimensional Wellness will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of this Site or any activity being conducted on this Site. 

CONSENT TO COMMUNICATIONS 

When you use the Site or Services, or send e-mails, messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically. You agree that (a) all agreements and consents can be signed electronically and (b) all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such notices and other communications be in writing. 


By providing your mobile number, you are agreeing to be contacted by or on behalf of Dimensional Wellness at the mobile number you have provided, including calls and text messages, to receive informational, Service-related (e.g., progress tracking, reminders, etc.) communications relating to the Site and Services. Dimensional Wellness is committed to being compliant with the Controlling the Assault of Non-Solicited Pornography and Marketing Act (“CAN-SPAM ACT”) and the Telephone Consumer Protection Act (“TCPA”). Emails, newsletters, and text messages received from us are intended to fully comply with the CAN-SPAM ACT and the TCPA. In the event you receive an email or text message from us which you do not believe is fully compliant with the CAN-SPAM ACT or the TCPA, please contact us immediately at tina@atransformativejourney.com


You shall not use or permit any of your employees, agents, or affiliates to market, promote, or solicit Dimensional Wellness Services in ways that would violate the CAN-SPAM ACT, the TCPA or any other laws. You shall not infringe on the rights of others; distribute chain letters or unsolicited bulk electronic mail (“spamming”); propagate computer worms or viruses; use a false identity; attempt to gain unauthorized entry to any site or network; or infringe copyrights, trademarks, or other intellectual property rights. 

You further agree to comply with U.S. export laws concerning the transmission of technical data and regulated materials via the Internet. 


INTELLECTUAL PROPERTY RIGHTS

All pages within this Site and any material made available for download are the property of Dimensional Wellness, or its licensors or suppliers, as applicable. 

You agree not to store, copy, modify, reproduce, retransmit, distribute, disseminate, rent, lease, loan, sell, publish, broadcast, display, or circulate such information to anyone. Use, reproduction, copying, or redistribution of Dimensional Wellness’s trademarks, service marks, and logos are strictly prohibited without the prior written permission of Dimensional Wellness, as applicable. The immediately foregoing sentence also applies to any third party trademarks, service marks, and logos posted on the Site. Nothing contained on the Site should be construed as granting, by implication, estoppel, waiver or otherwise, any license or right to use any trademarks, service marks, or logos displayed on the Site without the written grant thereof by Dimensional Wellness or the third party owner of such trademarks, service marks, and/or logos. The Site may contain other proprietary notices and copyright information, the terms of which you agree to follow.

Dimensional Wellness may delete any information provided by you that it deems in its sole discretion fraudulent, abusive, defamatory, obscene, or in violation of copyright, trademark, or other intellectual property or ownership right of any other person or entity.


Subject to these Terms of Use, Dimensional Wellness grants you a revocable, nontransferable (except as provided below), personal, nonexclusive license to use the Site.  Dimensional Wellness reserves the right, in its sole discretion, to terminate your access to all or part of this Site, with or without cause, and with or without notice. All rights not expressly granted to you in these Terms of Use are reserved and retained by Dimensional Wellness or its licensors, suppliers, publishers, rights holders, or other content providers. 

You may provide suggestions, comments or other feedback (collectively, “Feedback”) to Dimensional Wellness with respect to its Services. Feedback is voluntary. Dimensional Wellness may use Feedback for any purpose without obligation of any kind. To the extent a license is required under your intellectual property rights to make use of the Feedback, you grant Dimensional Wellness an irrevocable, non-exclusive, perpetual, fully-paid-up, royalty-free license to use the Feedback in connection with Dimensional Wellness’s business, including the enhancement of the Services. 


PROHIBITED USES

You may use the Site only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Site:

  • In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the United States or other countries).

  • In any way that infringes or facilitates infringement on any copyright, patent, trademark, trade secret, or other proprietary, publicity, or privacy rights of any party, including such rights of third parties.

  • To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.

  • To post or transmit: (a) a message under a false name; or (b) any data, materials, content, or information (including, without limitation, advice, and recommendations) which is (1) libelous, defamatory, obscene, fraudulent, false, or contrary to the ownership or intellectual property rights of any other person, or (2) contains or promotes any virus, worm, Trojan horse, time bomb, malware, or other computer programing or code that is designed or intended to damage, destroy, intercept, download, interfere, manipulate, or otherwise interrupt or expropriate the Site or the Services, personal information, software, equipment, servers, or Information or facilitate or promote hacking or similar conduct.

  • To impersonate or misrepresent your identity or falsely state or misrepresent your affiliation with a person or entity.

  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm Dimensional Wellness or users of the Site, or expose them to liability.

Additionally, you agree not to:

  • Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party’s use of the Site, including their ability to engage in real time activities through the Site.

  • Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.

  • Use any device, software, or routine that interferes with the proper working of the Sites.

  • Use any meta tags or any other "hidden text" utilizing Dimensional Wellness’s name or trademarks without the express written consent of Dimensional Wellness.

  • Harvest or collect personal information about any other individual who uses the Site or the Services.

  • Copy, distribute, modify, reproduce, publish, or use, in whole or in part, the Site or Services except for purposes authorized or approved in writing by Dimensional Wellness.

  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

  • Attempt to reverse engine, reverse assemble, reverse compile, decompile, disassemble, translate, or otherwise alter, defraud, or create false results from any executable code, information on, or received by this Site.

  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.

  • Attack the Site via a denial-of-service attack or a distributed denial-of-service attack.

  • Tamper, hack, spoof, copy, modify, or otherwise corrupt the administration, security, or proper function of the Site or the Services.

  • Otherwise attempt to interfere with the proper working of the Site.


ACCURACY OF INFORMATION

Although Dimensional Wellness attempts to ensure the integrity and accurateness of the Site and Service descriptions, it makes no representations, warranties or guarantees whatsoever as to the correctness or accuracy of the Site, Service descriptions and other content on the Site. It is possible that the Site could include typographical errors, inaccuracies or other errors, and that unauthorized additions, deletions and alterations could be made to the Site by third parties. In the event that an inaccuracy arises, please inform Dimensional Wellness at tina@atransformativejourney.com so that it can be corrected. Information contained on the Site may be changed or updated without notice. Additionally, Dimensional Wellness shall have no responsibility or liability for information or content posted to the Site from any non-Dimensional Wellness affiliated third party.


NO FUNCTIONALITY GUARANTEES

Dimensional Wellness reserves complete and sole discretion with respect to the operation of the Site and the Services. We may withdraw, suspend, or discontinue any functionality or feature of the Site or the Services among other things. We are not responsible for transmission errors, corruption, or compromise of information carried over local or interchange telecommunications carrier. We are not responsible for maintaining information arising from use of the Site or with respect to the Services. We reserve the right to maintain, delete, or destroy all communications or information posted or uploaded to the Site or the Services in accordance with our internal record retention and/or destruction policies.


LINKS TO THIRD PARTY SITES 

Dimensional Wellness makes no representations whatsoever about any other website that you may access through this Site. When you access a third party site, please understand that it is independent from Dimensional Wellness, and that Dimensional Wellness has no control over the content on that website. In addition, a link to a third party website does not mean that Dimensional Wellness endorses or accepts any responsibility for the content, or the use, of the linked site. It is up to you to take precautions to ensure that whatever you select for your use or download is free of such items as viruses, worms, Trojan horses, and other items of a destructive nature. If you decide to access any of the third party sites linked to this Site, you do this entirely at your own risk.


USER INFORMATION

If you transmit any health or psychiatric information, medical and psychiatric history, conditions, problems, symptoms, personal information, consent forms, agreements, requests, comments, ideas, suggestions, information, files, videos, images or other materials to us or our Site (“User Information”), you agree not to provide any User Information that (1) is false, inaccurate, defamatory, abusive, libelous, unlawful, obscene, threatening, harassing, fraudulent, pornographic, or harmful, or that could encourage criminal or unethical behavior, (2) violates or infringes the privacy, copyright, trademark, trade dress, trade secrets or intellectual property rights of any person or entity, or (3) contains or transmits a virus or any other harmful component. You agree not to contact other site users through unsolicited e-mail, telephone calls, mailings or any other method of communication. You represent and warrant to Dimensional Wellness that you have the legal right and authorization to provide all User Information to Dimensional Wellness for use as set forth herein and required by Dimensional Wellness. 


You agree to defend, indemnify, and hold harmless Dimensional Wellness from and against all third party claims, damages, and expenses (including reasonable attorneys’ fees) against or incurred by us arising out of any User Information you upload to or transmit through the Site.

CLAIMS OF COPYRIGHT INFRINGEMENT

We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with applicable law. In accordance with the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”), if you believe any material accessible on or from the Site infringes your copyright, you may request removal of or access to those materials by submitting written notification (a “DMCA Notice”) to our copyright agent designated below:

ASSIGNMENT

You may not assign, transfer, or delegate the Terms of Use or any part thereof without Dimensional Wellness’ prior written consent. Dimensional Wellness may freely transfer, assign, or delegate all or any part of the Terms of Use, and any rights or duties hereunder or thereunder. The Terms of Use will be binding upon and inure to the benefit of the heirs, successors, and permitted assignees of the parties. 


FORCE MAJEURE

We will not be deemed to be in breach of these terms or liable for any breach of these terms or our privacy policy due to any event or occurrence beyond our reasonable control, including without limitation, acts of God, terrorism, war, invasion, failures of any public networks, electrical shortages, earthquakes or floods, civil disorder, strikes, fire or other disaster.
